Rights of Way
We deal with disputes over private and public rights of way.
Private right of way disputes arise in relation to both
commercial and residential land. The rights themselves often arise
by long and uninterrupted use which may be the subject of
investigation and debate. Other areas of dispute could be the
extent of the right (eg. pedestrian, or car etc) and intensity
(where there has been development of the land benefiting from the
right of way is it lawful for more people to exercise the
right?).
The increased value of country properties and privacy has
resulted in a growing number of challenges to claims of public
rights of way. We can make representations to local authorities and
represent clients at public inquiries.
