Solicitors Negligence
It is compulsory for all solicitors to be insured against
professional negligence claims. The minimum sum insured per claim
is £2m. Most claims are for a great deal less. Therefore, a
claimant can derive some comfort from the fact that if his claim is
successful he will receive compensation. It is also worth noting
that, at one time or another, claims (good and bad) will have been
made against the majority of solicitors.
Because of the nature of our practice the professional
negligence claims against solicitors we deal with tend to be
property-related. Many of them arise from conveyancing negligence
relating to sale and purchase agreements, lease extensions, and
landlord and tenant matters. They are often caused by failure to
meet deadlines. Not all claims arise from transactions. Some of
them arise from solicitors who have been negligent in conducting
litigation.
We are experienced in handing complex and/or multi-party cases
involving solicitors professional negligence.
As with all claims it is best to obtain advice as early as
possible. We can advise on the merits of a claim, mitigation,
procedures and funding, and we can help in presenting the case and
dealing with the solicitors' insurers.
These sorts of claims, like claims against other professionals,
may be suitable cases for conditional fee agreements.
